1. Fields of application of the General Conditions of Sale
These general conditions of sale (hereinafter referred to as the "GTC") express the entirety of the obligations of the parties. In this sense, the consumer is deemed to accept without reservation all the provisions provided for in these general conditions of sale. D'Atelier Vitrine Marcucci undertakes for its part to respect its role as creator within the framework of the said conditions. These T&Cs are subject to change and/or updates. The GCS applicable to an order are those in force on the day of the order. The purpose of these T&Cs is to specify the rights and obligations of the parties in the context of the online sale of goods and services offered by Sylvie Marcucci to the customer. They constitute the contractual framework of the sale with the order form, the confirmation e-mails, the automatic recording systems used by the site and the invoice.
2. Acceptance and validation of the Order
Automatic recording systems are considered as proof of the nature, content and date of the order. 3. Product Availability
Orders will be accepted within the limits of available stocks. Sylvie Marcucci cannot be held responsible for non-substantial errors that could affect the description and presentation of the products, their components, accessories or materials. Atelier vitre Marcucci guarantees the purchaser, in respect of hidden defects that may affect the delivered products, within the framework of a replacement of the defective products, or of the parts rendering them unfit for their use, or their reimbursement without being able to be considered by the buyer as responsible for any harmful consequences that these hidden defects could have caused. Sylvie Marcucci guarantees the products for a period of 2 months from the date of delivery.
5. Prices & Tariffs
The prices are indicated in euros and are applicable only on the date of the sending of validation of the order by the customer. The price indicated on the product sheets does not include transport. The price indicated in the order confirmation is the final price, expressed for France and the countries of the European Union. This price includes the price of the products, the packaging costs and the transport costs. Full payment must be made when ordering. The customer is solely responsible for checking the possibilities of importing the products ordered with regard to the law of the territory of the country of delivery. 5. Prices & Tariffs

6. Method of Payment

7. Terms of delivery
The products are delivered to the address indicated by the customer when ordering. Delivery is deemed to have been made upon delivery of the product to the carrier. The client must verify the completeness and conformity of the information he provides to Sylvie Marcucci. The latter cannot be held responsible for any input errors and the consequences in terms of delay or delivery error. In this context, all costs incurred for the reshipment of the order will be entirely the responsibility of the customer. For deliveries outside mainland France, the customer agrees to pay all taxes due on the importation of products, customs duties, Value Added Tax (VAT) and all other taxes due under the laws of the country of receipt of order. Sylvie Marcucci de facto disclaims any legal liability if the payment of taxes was not not made by the customer. Sylvie Marcucci cannot be held responsible for delays in delivery due to errors or disruptions attributable to carriers (total or partial strike in particular of postal services and means of transport and/or communications). 8. Delivery problem due to the carrier

9. Delivery error - Non-compliant products

10. Right of withdrawal
The customer has, within 14 working days from the delivery of his order, a right of return, at his expense, for exchange or refund, of products that do not suit him in accordance with article L121-16 of the Consumer Code. In all cases the return is made at the risk of the consumer. Sylvie Marcucci recommends that consumers return their products by colissimo with a recommendation or additional insurance guaranteeing them, where applicable, compensation for the products up to their actual market value in the event of spoliation or loss of this merchandise. The returned product must be in its original condition and packaging. 11. Retention of title
Notwithstanding the provisions of article 1583 of the Civil Code, it is agreed with the customer that the transfer of ownership of the products sold by Sylvie Marcucci is suspended until full payment of their price. In the absence of payment by the customer of a fraction of the price on one of the agreed deadlines, the sale is automatically terminated if Sylvie Marcucci so wishes.
